摘要:近年来互联网发展迅速，随之而来的是网络著作权的保护问题日益突出。我国著作权立法相对滞后，网络著作权得不到有效地保护。为了有效的保护网络著作权人的相关权利，促进网络文化的健康发展，本文将针对网络著作权保护的意义进行解析，并剖析网络环境下著作权保护存在的缺陷，在借鉴国际上和各国某些立法的基础上，结合我国基本国情对如何完善我国网络著作权保护提出相关建议和观点，以期有利于我国网络著作权保护机制的不断完善。

In order to effectively protect the copyright of network human rights, promoting the healthy development of network culture, this article will focus on the network copyright protection significance, and analysis of copyright protection under network environment defects, in drawing lessons from international and from all other countries on the basis of some legislation,combined with the basic situation of our country on how to improve China's network copyright protection of the right to put forward the related suggestions and views, which will be helpful to our country network copyright protection system.

当前侵犯网络著作权的行为日渐猖獗，严重阻碍网络业的健康发展，而解决这一难题的关键在于通过保护网络著作权来平衡各方利益。法律是一门公平的艺术，而利益关系正是所有法律条文的核心内容，所谓的公平与否，直接所指乃是利益的分配问题。互联网环境下的著作权保护涉及多方主体的利益，例如著作权权利人、著作权人团体、网络用户、政府部门等等。网络环境下著作权保护的核心是协调不同主体之间的利益分配，主要是网络环境下著作权人和网络用户之间的权利义务配比问题，其目的是形成公平、公正、高效的法律机制，在不损害著作权人创作激情的基础上，使更多的网络用户能够享用到廉价的作品，从而促进信息的自由流通和科学、文化、艺术的传播，从而在保障私益的基础上，增进公益。
