摘要:人权，是人作为人依据其自然属性和社会本质所应当享有的权利。宪法是人权的保障书，人权与宪法是紧密联系在一起的。随着人权受到的关注日益热烈，我国宪法人权保障问题也同样受到各界的关注。我国宪法人权保障在现阶段仍然不完善，本文从我国宪法人权保障的必要性出发，分析我国宪法人权保障存在的主要问题并借鉴国外宪法人权保障的经验，提出完善我国宪法人权保障的若干建议。

Abstract:As a person, everyone has a right, according to his natural attribute and social essence, which is called human rights. Constitution, guaranty of human rights, is closely connected with human rights. With human rights being increasingly concerned, constitutional protection of human rights is subject to public concern as well. Constitutional protection of human rights is not complete in China at the present stage. On the basis of the necessity of human rights protection in our constitution, this paper analyze the main problems of human rights protection in our constitution, and use the experiences of foreign constitutional protection of human rights as references to come up with several suggestions to perfect human rights protection in our constitution.

人权的平等性，是指不论老幼、贫富、贵贱，每个人在人权享有上是一律平等的，只有承认人人皆平等地享有人权，人权才会存在。[夏勇.人权概念起源[M].（原版导言）.北京：中国政法大学出版社,2001.]上世纪八十年代末起，随着理论方面的深入研究，人权问题逐渐成为热点而受到我国的高度关注。纵使在人权保障是全人类共同价值追求这点上，我国与资本主义国家立场基本相同，但无奈于生产力发展水平、历史文化方面的差异，使得建立与完善我国宪法人权保障制度成为一个难题。笔者认为完善我国宪法人权保障制度对于我国人权保障非常重要，并在下文列举原因以论证，并提出若干完善我国宪法人权保障制度的具体建议。
