摘要：本文通过调查分析南京市雨花区铁心桥村违章建筑的现状，分析其产生的原因，主要包括：农民法律意识模糊、房屋出租有利可图、动迁农民为多分住房面积而大兴违章建筑、管理体制不顺、法律法规的不完善。最后针对以上产生原因给出相应的解决措施。

违章建筑即是违反国家法律法规规章的强制性规定建造的房屋。国家没有统一的定义，各地方政府则有明确的规定。一般是指未取得建设工程规划许可证或者违反建设工程规划许可证核定的相关内容建设的建筑。主要包括未经批准擅自建房、擅自改变建设工程规划许可证的建筑、擅自改变了使用性质建成的建筑、临时建筑建设后超过有效期未拆除的建筑。
