摘要:儿童食品安一直受到国家和社会重视。本文通过分析关于儿童食品安全的立法价值，进一步指出了关于儿童食品安全的立法在我国建立的必要性和重要性。而且，无论从国家政策、法律法规还是实践的角度，在我国建立儿童食品安全法都有一定的可行性。但由于关于保护儿童食品安全的制度在我国现行法律法规中没有明确的规定，所以在司法实践中各地的做法并没有统一的标准。在此，通过借鉴儿童食品安全保护在国际上的经验，对我国构建儿童食品安全法提出了具体的若干建议。

儿童食品安全问题的频繁出现，令儿童食品安全成为当今社会的热点问题。社会在进步，科技在发展，但儿童食品安全问题却是与社会发展方向背道而驰。儿童是国家未来的栋梁，对于儿童的食品安全问题应尤为注意。但近年来出现的一系列关于毒奶粉的食品安全问题，令人们感到心惊胆颤。面对着这一系列的问题，如何建立完善一个儿童食品安全法律体系成为了完善食品安全法律体系的头等大事。
