摘要:消费者冷静期最早起源于美国,现欧美、日本等许多国家也已将消费者冷静期纳入了本国的法律并广泛应用。我国在即将修订的《消费者权益保护法》中也拟增设消费者冷静期制度,而在对于是否在消费者冷静期制度中设置购房后悔权上则存在很大争议。本文从保护我国消费者冷静期制度中购房后悔权必要性出发,分析我国购房后悔权存在的主要问题,借鉴其他国家和地区对冷静期制度的规定,对我国消费者冷静期制度中购房后悔权的保护提出了若干建议。

Abstract:Consumer calm period originated in the United States of America.Now Europe and the United States, Japan and many other countries have also been incorporation it into their legal and widely applied. China will add Consumer calm period to the revision of the" Law of the People's Republic of China on Protection of Consumer Rights and Interests".However,it's controversial whether setting consumer calm period in system of property right.This article starts with the necessity of protecting the purchase of regret right of the consumer calm period,analyzes the mean problem of the purchase of regret right,and draws the construction of consumer calm period from other countries and regions,then puts forward some suggestions on how to protect the purchase of regret right of the consumer calm period.

在购房者与房地产开发商解除商品房买卖合同后,开发商必须向银行归还已经占有的借款,而银行只有收到房地产开发商以购房消费者名义还来的借款后,才能认定购房消费者已经履行了全部还款义务,第三方监督队伍方的建立便作为第三方平台为购房消费者、房地产开发商及银行保管按揭贷款,保障购房后悔权的顺利实现。第三方监督队伍在购房消费者与房地产开发商解除合同后,可以协助保存开发商退回的按揭贷款,并在购房消费者与银行解除借款合同后,第三方监督队伍方再将借款以购房消费者的名义归还银行,使购房者与开发商、银行之间的合同真正完全解除,购房后悔权也顺利实现。
在消费者冷静制度中设置购房后悔权,对消费者权益保护内容的完善、中国法制的健全发展都有很大的作用,笔者通过对购房后悔权现存的问题进行探究,在本文中对构建购房后悔权的细则规范提出几点意见。在探究过程中发现,对购房后悔权的保护涉及了多领域的法律规范,其构建至实现都涉及多方面问题,在当今房地产市场的不断发展变化下,以后施行会有许多新问题需要留意,购房后悔权也需要在不断地适应发展及完善。
