【摘要】人类生产力的发展使得气候变暖问题不断突出，国际社会通过《京都议定书》等一系列文件建立了国际碳交易市场，以此作为减少温室气体排放的手段之一。虽然当今国际碳交易市场不断完善和发展，但是依旧存在诸如市场分散、统一法律的缺失等问题。这些问题追根溯源都是对碳排放产权分析的缺失和理解偏差形成的。在产权的视角下，国际碳交易市场应该在统一有效的法律制度、配额分配等方面进行完善。

Abstract: With the development of human productive forces, global warming continues to stick out. The international community established an international carbon trading market as one of the means to reduce greenhouse gas emissions through the “Kyoto Protocol” and a series of documents. Although the current international carbon trading market is in the continuous improvement, such issues still exist as the fragmentation of the market, the lack of uniform laws and so on. Such problems should trace back to the lack of the analysis of carbon emission rights and misunderstanding of this bias. In view of property rights, the international carbon trading market should be improved in the aspects of unified and effective legal system and quota allocation.

20世纪以来，随着人类生产力的发展，全球气候变暖问题日渐突出。为了缓解气候变暖的趋势，联合国于1997年通过了《京都协定书》，要求国际社会采取各种措施控制或减少二氧化碳等温室气体的排放，碳交易就是其中一种主要手段。它对各国碳排放量进行定额，并允许配额之间的交易，用市场的手段来给予规制碳排放行为，在控制环境的同时，也催生了国际碳交易市场的繁荣和快速发展。但是在碳交易市场高速发展的今天，我们也应当看到碳交易市场存在的诸如定价权不明晰、市场不统一等一系列问题，成为在21世纪阻碍碳交易市场发展的痼疾。追根溯源地分析这些问题，其均是因为对于碳产品产权的定义和特征的理解存在偏差。如果对碳交易产权进行正确的理解和分析，并从产权角度对现存问题对症下药，就能够一定程度上解决目前碳交易市场存在的问题。
